COMMISSIONED CREATIVE SERVICES POLICY

1. Purpose and Scope

Transcend Studio provides commissioned creative services for individuals, artists, musicians, bands, businesses and other creative projects.

These services are distinct from Transcend Mentoring. Customers commissioning creative work are purchasing an agreed creative service or outcome, rather than a mentoring package.

This policy applies to the following service categories:

  • Songwriting & Composition: developing musical ideas, lyrics, melodies, arrangements and compositions.

  • Recording Sessions: recording vocals, instruments and other suitable musical performances.

  • Music Production: developing and producing music, including arrangement and other agreed production work.

  • Project Collaboration: working collaboratively with artists or other creative practitioners toward a shared musical or creative outcome.

The precise scope of each service depends on the description provided at the time of purchase and the written Project Confirmation.

This policy should be read alongside the Transcend Studio Terms & Conditions, Booking, Cancellation & Refund Policy and Privacy Policy.

2. Enquiries, Quotes and Project Confirmation

Some services have published prices, while larger or more complex projects may require an individual quote.

A quote may be necessary where a project involves multiple songs, extensive production, several collaborators, additional recording requirements or a scope that cannot reasonably be defined by a standard service listing.

Before work begins, Transcend Studio will confirm the relevant project details in writing.

The Project Confirmation may include:

  • Customer and project details.

  • The agreed service and creative objectives.

  • The scope of work and deliverables.

  • The project price and payment arrangements.

  • The anticipated start date and estimated timeline.

  • The number of included revisions, where applicable.

  • Customer responsibilities and required materials.

  • Intellectual property, ownership, credits, royalties and licensing arrangements.

  • Any agreed involvement of external collaborators.

  • Any additional terms specific to the project.

The Project Confirmation provides a shared reference for what has been agreed.

If the customer's requirements change materially after confirmation, the parties may need to agree a revised scope, price or timeline in writing.

3. Payment

Unless a different arrangement has been expressly agreed in writing, commissioned creative services must be paid for in full in advance.

For projects involving a separately agreed payment schedule, the applicable amounts, due dates and conditions will be recorded in the Project Confirmation or another written agreement.

Transcend Studio will normally begin work once the required payment and project information have been received and the project start arrangements have been confirmed.

Payment does not, by itself, establish that every copyright or intellectual property right associated with the work has transferred to the customer. Ownership and usage rights are governed by Section 10 of this policy and the applicable written agreement.

4. Project Scope and Deliverables

Each commissioned service has a defined purpose and scope.

The exact deliverables depend on the service purchased and the Project Confirmation.

For example:

  • A songwriting session may focus on exploring or developing an idea without guaranteeing a finished song.

  • A composition service may include agreed songwriting elements without including recording, production, mixing or mastering.

  • A recording session may include recording and basic session organisation without including extensive editing, tuning or post-production.

  • A music production service may include agreed production work without automatically including every additional service required for commercial release.

  • A collaboration project may involve shared creative development, with individual roles and responsibilities agreed in advance.

Customers should review the published service description and Project Confirmation to understand what is and is not included.

Transcend Studio will use reasonable care and skill in delivering the agreed service.

Where a deliverable depends on customer-supplied materials, approvals or participation, the customer is responsible for providing the required information promptly.

5. Project Timelines and Delivery

Project timelines are estimates based on the agreed scope, available information, anticipated workload and any relevant dependencies.

Where appropriate, the Project Confirmation will record an estimated start date, milestones or delivery date.

Timelines may change where:

  • The customer requests changes to the original scope.

  • Required materials, feedback or approvals are delayed.

  • Additional work is agreed.

  • A collaborator or third-party dependency affects progress.

  • Illness, technical failure or another unforeseen circumstance materially affects delivery.

Transcend Studio will communicate material changes and, where appropriate, discuss a revised timeline.

Customers should allow reasonable time for review, feedback and agreed revisions.

A delivery estimate should not be treated as a guaranteed date unless the written agreement expressly identifies it as such. This does not remove any legal rights the customer may have where a service is not delivered within an agreed or legally required timeframe.

6. Customer Responsibilities

To support effective project delivery, customers are expected to:

  • Provide accurate information about the project and intended outcome.

  • Supply agreed lyrics, demos, recordings, reference tracks, files and other materials in a usable format.

  • Ensure they have the necessary rights or permissions for materials they supply.

  • Respond to reasonable requests for feedback, approvals or clarification.

  • Review deliverables within any agreed review period.

  • Communicate proposed changes as clearly as possible.

  • Pay agreed fees in accordance with the applicable payment terms.

  • Treat Transcend Studio and any involved collaborators respectfully.

Where customer delays or missing materials affect delivery, Transcend Studio may need to revise the estimated timeline.

If the customer requests work beyond the agreed scope, the additional work may require a revised quote or Project Confirmation.

7. Revisions and Additional Work

The number and nature of included revisions will be specified in the service description, Project Confirmation or separate written agreement.

Where revisions are included, they are intended to refine the agreed work within the original scope.

Examples may include adjustments to an arrangement, production balance, a lyric detail or another agreed creative element, depending on the service.

The following may be treated as additional work where they fall outside the agreed scope:

  • Replacing a substantially developed creative direction.

  • Requesting a different deliverable from the one originally agreed.

  • Adding new songs, sections, instruments or production elements.

  • Requesting extensive changes after approving an earlier stage.

  • Requiring additional recording, editing, mixing or other services not included in the original agreement.

  •

Transcend Studio will explain the proposed additional work and any additional cost before proceeding.

Additional chargeable work will only proceed once the customer has approved the revised scope and cost in writing.

If no additional work is agreed, the project will continue according to the original scope, subject to the terms of the agreement and applicable law.

8. Review, Approval and Delivery of Files

Deliverables will be provided in the formats and through the delivery method agreed for the project.

Depending on the service, delivery may take place by email, a cloud-transfer link or another agreed digital method.

During an in-studio appointment, AirDrop may be used to transfer suitable non-master files where appropriate.

The Project Confirmation should identify the intended final deliverables, such as audio files, project exports, recordings, compositions or other agreed materials.

Unless expressly included in the agreement, delivery of a finished audio file does not automatically include:

  • The complete digital audio workstation project.

  • All individual stems or multitrack recordings.

  • Third-party plugin presets or proprietary files.

  • Commercial mastering.

  • Distribution, release administration or promotional services.

  • Ownership of all underlying composition, recording or third-party rights.

Where a customer requires additional formats, source files, stems or project files, these should be agreed in advance or quoted separately where appropriate.

Customers should download and securely store delivered files within a reasonable period.

9. Recording, Production and Technical Dependencies

Creative services may depend on equipment, software, plugins, instruments, recording facilities, third-party platforms or external contributors.

Transcend Studio will take reasonable care when using its equipment and managing project files.

However, a particular sound, performance, technical result or creative outcome cannot be guaranteed unless it has been expressly agreed and is reasonably capable of being delivered.

Where a technical issue materially affects delivery, Transcend Studio will consider a reasonable solution, which may include repeating affected work where appropriate, adjusting the workflow or agreeing a revised timeline.

Any third-party software, samples, loops, plugins or other licensed materials remain subject to their applicable terms.

Transcend Studio cannot grant a customer rights to third-party materials beyond the rights available under the relevant license.

10. Intellectual Property, Ownership and Commercial Use

Intellectual property arrangements depend on the nature of the project and the contributions made by each participant.

The applicable Project Confirmation or separate written agreement should record any ownership, licensing, credit, royalty or commercial-use arrangements that need to be established.

10.1 Copyright and ownership

Payment for a commissioned service does not automatically transfer every copyright or intellectual property right associated with the work.

Different rights may apply to:

  • Lyrics, melodies and musical compositions.

  • Songwriting and co-writing contributions.

  • Sound recordings and master recordings.

  • Production contributions and arrangements.

  • Performances.

  • Third-party samples, loops and other licensed materials.

The written agreement should identify the relevant rights and explain whether they are retained, licensed, assigned or shared.

Transcend Studio cannot assign or license rights that it does not own or control.

10.2 Commercial release and use

Unless a different arrangement is agreed in writing, customers may commercially release and use the finished work after full payment, subject to the ownership, licensing, credit, royalty and third-party rights arrangements applicable to the project.

Where a customer needs exclusive ownership, a particular license, a transfer of rights or a specific royalty arrangement, this must be agreed in writing.

Customers should not assume that payment alone gives them exclusive ownership of every contribution or element in a recording or composition.

10.3 Songwriting, co-writing and composition

Where a project involves songwriting, composition or co-writing, the parties should agree on any relevant authorship, ownership, songwriting credits, publishing interests and royalty shares.

These arrangements should reflect the actual contributions and any agreed division of rights.

Where such arrangements are required, they should be recorded in writing before the relevant rights are committed or the work is released.

10.4 Master recordings and production

Where a project involves recording or production, the parties should clarify ownership or licensing of the master recording and any relevant underlying compositions.

The agreement should also identify any deliverables or rights that are excluded from the service.

Third-party materials remain subject to their own licensing restrictions.

10.5 Educational work

For educational and mentoring services, learners retain ownership of their original creative work unless otherwise agreed in writing.

Transcend Studio does not automatically acquire ownership of a learner's music merely because it is discussed or developed during a mentoring session.

10.6 Disputed or unconfirmed rights

Where ownership, licensing, authorship, credits or royalties remain unresolved, the parties should clarify the position before making commitments that depend on those rights.

Transcend Studio may require written confirmation of the relevant arrangements before beginning work or delivering a project intended for commercial use.

11. External Collaborators

Some projects may involve producers, musicians, vocalists, engineers, songwriters, designers or other external collaborators.

Where external collaborators are involved, Transcend Studio will clarify the relevant arrangements with the customer as appropriate.

Depending on the project, these arrangements may cover:

  • Each collaborator's role and responsibilities.

  • Fees and payment arrangements.

  • Deliverables and timelines.

  • Creative contributions and approvals.

  • Credits and attribution.

  • Intellectual property and licensing.

  • Royalty or revenue-sharing arrangements.

  • Confidentiality and use of project materials.

The involvement of a collaborator does not automatically mean that Transcend Studio owns or can transfer that person's rights.

Where a collaborator's contribution affects ownership, licensing, payment or delivery, the necessary arrangements should be agreed in writing before the relevant work proceeds.

A proposed alternative collaborator or provider will be subject to the customer's agreement where required by the applicable project arrangement.

12. Confidentiality and Portfolio Use

Transcend Studio will handle personal information in accordance with its Privacy Policy and any applicable confidentiality agreement.

Creative work may also be subject to separate confidentiality or non-disclosure arrangements where agreed.

Unless otherwise agreed in writing, Transcend Studio may feature completed creative work in its portfolio or marketing only after the customer has released that work publicly.

Unreleased songs, private demos, confidential recordings and other unpublished project materials will not automatically be treated as available for public use.

Where the customer requests a different publicity arrangement, it should be agreed in writing.

Any use of a customer's name, image, voice, performance or other personal information in promotional material remains subject to the applicable consent and privacy requirements.

13. Cancellation, Changes and Refunds

Cancellations and refunds for commissioned creative services are governed by the Transcend Studio Booking, Cancellation & Refund Policy, the applicable Project Confirmation and any separate written agreement.

Customers should contact Transcend Studio as soon as possible if they wish to cancel, pause or materially change a project.

Refunds and cancellation charges will depend on the circumstances, the work supplied, the agreed terms and applicable statutory rights.

Where a customer exercises a statutory right to cancel during an applicable cancellation period, any charge for work already supplied will be handled in accordance with the applicable legal requirements.

Starting work does not automatically make the entire project fee non-refundable.

Once an applicable statutory cancellation period has expired, a customer-requested cancellation will normally not entitle the customer to an automatic refund, subject to the agreed terms and any statutory rights or remedies.

Where the customer requests additional work or a significant change to the project, the parties may agree a revised scope, price and timeline.

14. If Transcend Studio Cannot Complete a Project

If Transcend Studio becomes unable to complete an agreed project, it will contact the customer to explain the situation and discuss an appropriate way forward.

Depending on the circumstances, this may include:

  • Agreeing a revised delivery timeline.

  • Adjusting the project scope by mutual agreement.

  • Discussing an alternative collaborator or provider.

  • Agreeing another reasonable delivery arrangement.

An alternative provider will not be appointed to take over the customer's project without the customer's agreement where that agreement is required.

If no acceptable arrangement can be reached, Transcend Studio will provide any refund or other remedy required by the agreement and applicable law.

Nothing in this section excludes statutory rights or remedies that cannot lawfully be excluded.

15. Project Files and Retention

Transcend Studio will retain project files in accordance with its operational needs, the Privacy Policy and any applicable legal obligations.

As a general working practice, project files may be retained for up to six months after project completion, unless a different period has been agreed or another retention requirement applies.

This period is a general retention practice, not a guarantee that every file will remain available for the full period.

Customers should download and back up their delivered files rather than relying on Transcend Studio to act as a permanent storage service.

Where Transcend Studio owns intellectual property in a work, it may retain an archive of that work for legitimate recordkeeping, rights-management or portfolio purposes, subject to any applicable confidentiality agreement, privacy obligations and agreed restrictions.

Personal data and project materials will be handled in accordance with the Privacy Policy and applicable law.

16. Customer Property and Equipment

Customers must take reasonable care of studio equipment and property when attending recording sessions or other in-person services.

A customer may be responsible for the reasonable cost of repairing or replacing equipment or property where damage is caused by their negligence or misuse, subject to the circumstances and applicable law.

Customers should follow reasonable instructions concerning equipment, recording facilities and safe use of the studio.

17. Complaints and Disputes

If a customer is dissatisfied with a commissioned service, they should contact Transcend Studio directly and explain the concern.

Where possible, the customer should identify the relevant deliverable, project stage or agreed requirement so that the matter can be reviewed.

Transcend Studio will consider the complaint and aim to respond fairly and within a reasonable time.

Where appropriate, the parties may discuss a correction, revision within scope, revised delivery arrangement or another reasonable solution.

Nothing in this section limits any statutory rights or remedies available to the customer.

18. Relationship with Other Policies

This policy should be read alongside:

  • Transcend Studio Terms & Conditions.

  • Transcend Studio Booking, Cancellation & Refund Policy.

  • Transcend Studio Privacy Policy.

  • The relevant service description.

  • The Project Confirmation or separate written agreement.

Where a project-specific written agreement contains additional arrangements, those arrangements apply to the relevant project to the extent permitted by law.

Any ownership, royalty, licensing or confidentiality agreement should be considered alongside this policy rather than assumed to be covered in full by a general service booking.
