Service-related communications are different from marketing communications. For example, a booking confirmation, cancellation notice or important service update may be sent because it is necessary to provide the service and does not require marketing consent.

4. Marketing Communications
Transcend Studio may offer the opportunity to receive marketing and communications about:

-
new services and programmes;
-
music education and creative opportunities;
-
blogs, articles and other content;

Where consent is required, marketing emails or other electronic marketing communications will only be sent where you have actively opted in.

Marketing consent is separate from acceptance of our Terms & Conditions and is not required to purchase our services.

You can withdraw your marketing consent at any time by using the unsubscribe option provided in our communications or by contacting Transcend Studio.

We keep appropriate records of marketing preferences and consent.

Current ICO guidance requires electronic marketing consent to be specific, informed, freely given and based on a clear affirmative action where consent is required.

5. Our Lawful Bases for Processing
Depending on the circumstances, we may process personal information because:

Contract
The processing is necessary to provide a service you have booked or to take steps at your request before entering into a contract.

Legal obligation
We need to process certain information to comply with legal, accounting, tax or other regulatory requirements.

Legitimate interests
Processing may be necessary for legitimate business purposes, such as maintaining service records, managing communications, protecting our systems, improving services and handling enquiries, provided those interests do not override your rights.

Consent
Where we rely on consent, we will ask for it clearly and separately where appropriate. You can withdraw consent at any time, although this will not affect processing that took place before withdrawal.

The lawful basis used will depend on the particular purpose for which the information is processed.

6. Children & Young Learners
Transcend Studio provides services to learners of different ages, including children and young people.
For learners under 18, a parent or legal guardian must be involved in the initial registration and booking process and provide any required consent.

Where a learner is a young child, Transcend Studio may communicate with the parent or guardian rather than directly with the child for booking, administration and other appropriate matters.

Where a learner requires additional support or accessibility arrangements, relevant information may be provided by the learner or their parent/guardian so that appropriate arrangements can be considered.

We do not deliberately collect more information about children than is reasonably necessary for providing and managing the relevant service.

Where consent is the lawful basis for processing a child's personal information, we will apply the appropriate requirements for the child's age and circumstances.

7. Communication
We may communicate with learners, clients and parents/guardians through:

-
email;
-
the Transcend Studio website and booking system;
-
the Transcend Studio app, where applicable;
-
WhatsApp Business;
-
Asana; and
-
other communication or service platforms used by Transcend Studio.

WhatsApp Business may be used as an optional, direct communication channel between Transcend Studio and learners, clients or parents/guardians.

Where a learner under 18 has their own phone, and their parent or legal guardian permits them to communicate directly with Transcend Studio, WhatsApp Business may be used for appropriate service-related communication, such as discussing sessions, reminders, homework or learning-related matters.

Parents or guardians remain responsible for providing the appropriate permission for a learner under 18 to use this communication channel.

8. Learning, Mentoring & Asana
Asana may form part of the normal Transcend Studio learning and mentoring process.
It may be used for:

-
homework and practice activities;
-
learning resources;
-
lesson preparation;
-
progress tracking;
-
feedback; and
-
communication relating to a learner's development.
Information placed into Asana will be limited to information reasonably relevant to the learning or mentoring service.
Asana is a separate third-party service, and its own privacy terms also apply to information processed through its platform.

9. Online Sessions
Where an online service is provided, Transcend Studio may use Google Meet, FaceTime or another video-conferencing platform designated by Transcend Studio.

Information necessary to arrange and deliver the online session may be shared with the relevant platform.

Transcend Studio does not normally record online learning sessions unless this is specifically agreed and appropriate permission has been obtained.

10. Payments & Third-Party Services
Transcend Studio uses third-party platforms and service providers to operate its website, bookings, payments, communications and learning systems.

These may include:

-
Wix - website hosting, booking/account functionality and payment services;
-
Wix Payments and payment partners - processing payments through the payment methods offered at checkout;
-
Google Meet - online sessions;
-
Asana - learning and mentoring management;
-
WhatsApp Business - optional communication; and
-
other providers that may be introduced where necessary to operate or improve Transcend Studio services.

These providers may process personal information on behalf of, or in connection with, the services they provide.
Where required, appropriate contractual, technical and organisational measures will be used to protect personal information.

You should also review the relevant third-party provider's privacy information where you use their services.

11. Photography, Video & Audio Recording
Transcend Studio may create photographs, video or audio recordings in connection with studio activities, creative projects, performances, promotional material or content creation.

Where an identifiable person is intended to appear in promotional or public-facing material, Transcend Studio will seek the appropriate permission or consent separately where required.

For learners under 18, appropriate parent or guardian permission will be obtained where required.

Photography, video and recording permissions are handled separately from this Privacy Policy through the Transcend Studio Media & Recording Consent process.

12. Creative Work & Intellectual Property
Transcend Studio may process information relating to creative work produced during learning, mentoring, recording or other creative services.

For ordinary learning and mentoring services, learners retain ownership of their original creative work unless otherwise agreed in writing.

Where Transcend Studio provides professional production, recording, engineering, songwriting, collaboration or other commercial creative services, separate agreements may determine how personal information, recordings, credits, intellectual property and other rights are handled.

13. Cookies & Website Technologies
Our website may use cookies and similar technologies to:

-
provide core website functionality;
-
maintain account and booking functionality;
-
remember preferences;

Where consent is required for non-essential cookies or similar technologies, we will provide the appropriate controls.
You can also manage cookies through your browser settings.

14. How Long We Keep Your Information
We keep personal information only for as long as reasonably necessary for the purpose for which it was collected, including to provide services, maintain appropriate business records, resolve disputes and meet legal, accounting or regulatory requirements.

Different types of information may therefore be kept for different periods.
For example:

-
booking and service records may be retained after a learner's last session for administration, accounting, legal and business-record purposes;
-
marketing preferences may be retained so that we can respect your decision about receiving marketing;
-
records of consent or withdrawal may be retained where necessary to demonstrate compliance; and
-
information in learning systems may be retained for as long as reasonably necessary to provide and manage the relevant learning or mentoring service.
-

Where information is no longer required, we will take reasonable steps to delete or securely dispose of it.

15. How We Protect Your Information
We take reasonable technical and organisational measures to protect personal information against unauthorised access, loss, misuse, alteration or disclosure.

However, no online service or method of electronic transmission can be guaranteed to be completely secure.

You are responsible for keeping passwords and account credentials confidential and should notify us if you believe your account has been accessed without permission.

16. Your Data Protection Rights
Depending on the circumstances and applicable law, you may have rights to:
